§ 12-23. Permit to ditch or cut across or along a County road right-of-way.

  • It shall be unlawful for any individual, organization, or business to cut a ditch or trench across or along any County road right-of-way for any purpose without first obtaining a permit from the County Judge's office. This permit shall contain a time limit for making and repairing the roadway cuts to be set by the County Judge. Each application shall be accompanied by a cash bond, surety bond issued by a corporate surety, or a property bond secured by adequate property within Washington County, in an amount set by the County Judge in a uniform manner, for each proposed cut across a County or public road. The bond shall be in favor of Washington County, Arkansas, and shall assure that the road-bed will be properly repaired within the time limits set in the permit. The County shall not be held liable for cuts of any utility lines, which are located within the right-of-way of a County road. The County Judge shall report to the Quorum Court the amount set for any bonds posted pursuant to this section.
