§ 9-1. Joint County/city library system.

  • (a)

    [Washington County, and the cities of Fayetteville, Springdale, Elkins, Lincoln, Prairie Grove and West Fork] agree to operate a joint County/city library system as has been done since the dissolution of the Ozark Regional Library System.

    (b)

    The governing bodies shall be the existing County Library Board which provides for representation for all entities.

    (c)

    This agreement shall be deemed to be permanent in nature with the right of any party to withdraw upon six (6) months written notice.

    (d)

    The County Library Board is given authority to provide such services to the members as agreed upon and to distribute the county library mill to each member in a manner deemed fair and proper by the Board.

    (e)

    All property purchased by the County library and placed with any other party to this agreement shall remain property of the County and be identified as such. Any information compiled using said property shall remain that party's property, for example, data bases. Said party shall be given a reasonable amount of time to retrieve said information.

    (f)

    Each entity may acquire or hold and dispose of real or personal property jointly or individually.

    (g)

    Each entity shall have its own budget.

    (h)

    If there is a partial or complete termination of this agreement, each party shall retain ownership of it property purchased except as stated in subparagraph (e).
