§ 14-18. Enforcement.

  • The Washington County Judge is hereby authorized to direct the Washington County Attorney to institute proceedings in the name of Washington County in any court of competent jurisdiction to compel compliance with and to restrain any violation of the provisions of this Article, or any provisions of the Arkansas Solid Waste Management Act or the Arkansas Solid Waste Disposal Code which have been adopted by reference herein, and to require such remedial measures to be taken as may be necessary or appropriate to implement or effectuate the provisions and purposes of this Article. The County Judge is also authorized to seek criminal, civil, and administrative penalties as set out in the above reference to Solid Waste Management Act and Code in any court of appropriate jurisdiction in Washington County. Such proceedings shall provide that unless the violation is corrected within a reasonable length of time, to be determined by the Court, Washington County should be authorized to correct the violation and to have a lien upon the real property upon which the violation has occurred for costs incurred in correcting the violation. The County Attorney shall be further directed to recover any other expenses reasonably incurred by Washington County in removing, correcting or terminating any adverse effects resulting from the violation, including the cost of inspection, investigation or survey establishing such violation, and to recover payment for other expenses or actual damages resulting therefrom.
