§ 13-1. Protection of rural and agricultural property.

  • (a)

    (1)

    The County Judge shall cause a notice to be filed in the real estate records in the Office of Circuit Clerk stating the following: "If you purchase property in an unincorporated area of Washington County, you are hereby put on notice that agricultural operations may now or in the future be located in the vicinity."

    (2)

    The County Judge is hereby further authorized to disseminate this chapter and said notice to the public in a manner he deems wise and expedient.

    (b)

    Plats. All plats presented to the Planning Board and filed on record shall note the uses of adjacent property. The determination of said use shall be the responsibility of the developer.

    (c)

    Right to farm. The right to farm is hereby declared to be the policy of Washington County. A.C.A. § 2-4-101 et seq. is hereby adopted as a County Ordinance.

    (d)

    Enforcment. This section is amendatory to Washington County Code section 11-51 et seq., and enforceable as set out therein.
