§ 12-32. Weight limits on County bridges.

  • (a)

    The County Judge is authorized to set weight limits on any bridge twenty (20) feet or longer with the advice of the Arkansas Highway and Transportation Department in the unincorporated portions of the County.

    (b)

    The County Judge is further authorized to post said weight limits.

    (c)

    Any violation of the limits imposed herein shall constitute a misdemeanor punishable by a fine up to two hundred fifty dollars ($250.00) for the first offense and up to five hundred dollars ($500.00) for subsequent offenses.

    (d)

    The County Judge is also authorized to institute civil action to prevent any violation herein and to recover any damages to any bridge damaged as a result of a violation of this section.

    (e)

    If the County Judge determines there is a reasonable likelihood that any person, business or entity is about to violate these provisions, he may also require a bond be posted to pay for any damages incurred.

    (f)

    No person, firm or entity driving a vehicle in excess of weight limits or driving certain types of prohibited vehicles, as posted by the County Judge, shall use any bridge in violation of the posted limitations. A violation of this Subsection shall be punishable by a fine of five hundred dollars ($500.00) for each violation or by appropriate civil action by the County Judge.
